Elderly pedestrian killed when car jumps curb

NEW YORK (WABC) -- 62-year-old Denise Baum is covered from head-to-toe in bruises, but it is her shattered heart which stings the most.

She and her husband were trying to hail a cab Saturday night on Park Ave and 59th Street when a two-car collision at that same intersection and at that same moment, sent one of the vehicles flying in their direction.

By the time the Mazda stopped, 80-year-old Rubin Baum was under the car and no longer breathing.

"He was pinned under the car, he was pinned - I couldn't pick up the car," Denise said.

"I heard the crash - it hit the man and woman on the corner waiting for a cab," said eyewitness Terry Hill.

Rubin Baum received two Purple Hearts for his valor and heroism during the Korean War.

Denise believes her husband's last act alive was to push her out of the way, which is why she survived, and he didn't.

"I believe he shoved me, I remember going in the air," Denise said.

Rubin Baum was debonair and dashing, and wore his decades well.

He taught his children to be kind to strangers and to root for the Giants.

He danced through his life with his wife. Tonight, all she is asking for is answers.

The minivan has diplomatic plates. Police tell Eyewitness News that the Pakistani official was not in the car during the accident, and police do not believe either driver will be charged. They are calling this a tragic accident.

US ambassador killed in consulate attack in Libya

AP  JIM KUHNHENNLIBYA -- President Barack Obama vowed Wednesday the United States would "work with the Libyan government to bring to justice" those who killed U.S. ambassador Chris Stevens and three other American personnel in an attack on the consulate in Benghazi.

"Make no mistake. Justice will be done," he said in an appearance at the Rose Garden outside the White House.

Obama, who ordered an increased in security at U.S. facilities overseas, said he "condemns in the strongest possible terms the outrageous and shocking" attack.

He spoke after Republican presidential challenger Mitt Romney condemned the attack, and criticized the administration for its initial response to a separate incident on Tuesday, the breach of the U.S. embassy in Cairo.

The president spoke with Secretary of State Hillary Clinton at his side as the deaths in Libya quickly roiled the U.S. political campaign, now in its final seven weeks.

As he departed the Rose Garden, the president did not respond to shouted questions from reporters asking him to respond to Romney's own statement.

"Make no mistake we will work with the Libyan government to bring to justice the killers who attacked our people," he said, referring to the events in Libya.

He also said, "We reject all efforts to denigrate the religious beliefs of others, but there is absolutely no justification for this type of senseless violence, none."

The incidents in both Arab countries were reportedly the work of protesters angry over a film that ridiculed Islam's Prophet Muhammad.

Romney's criticism appeared limited to an initial statement issued the previous day by the U.S. Embassy in Cairo. He said it was "akin to an apology," and that said as president, Obama bears responsibility for it. "They clearly sent mixed messages for the world," he said of the administration.

The attacks occurred Tuesday night in the eastern city of Benghazi by protesters angry over a film that ridiculed Islam's Prophet Muhammad, according to Libya officials. Ambassador Chris Stevens, 52, was killed when he and a group of embassy employees went to the consulate to try to evacuate staff as the building came under attack by a mob guns and rocket propelled grenades. Three other Americans were also killed.

Stevens is the first U.S. ambassador to be killed in an attack since 1979, when Ambassador Adolph Dubs was killed in Afghanistan. The State Department identified one of the other Americans killed Tuesday as Sean Smith, a foreign service information management officer. The identities of the others were being withheld pending notification of next of kin.

In a written statement earlier Wednesday, Obama called Stevens a "courageous and exemplary representative of the United States." ''I strongly condemn the outrageous attack on our diplomatic facility in Benghazi," Obama said in the statement.

The four Americans, he said, "exemplified America's commitment to freedom, justice, and partnership with nations and people around the globe."

Obama was informed about the developments in Libya by his National Security Adviser Tom Donilon as the president began a weekly meeting Secretary of Defense Leon Panetta and Chairman of the Joint Chiefs of Staff Martin Dempsey. The White House said Obama was kept apprised throughout the evening and then again Wednesday morning.

The Pentagon said early Wednesday that it was working with the State Department on Obama's order for increased security around the world. "We are following this tragic incident closely with the State Department," Lt. Col. Steven Warren, a Defense Department spokesman said. "We are prepared to support the State Department in any way."

U.S. officials said some 50 Marines were being sent to Libya to reinforce security at U.S. diplomatic facilities in the aftermath of an attack in the eastern city of Benghazi that killed the U.S. ambassador and three American members of his staff.

The Marines are members of an elite group known as a Fleet Antiterrorism Security Team, whose role is to respond on short notice to terrorism threats and to reinforce security at U.S. embassies. They operate worldwide.

The officials who disclosed the plan to send the Marines spoke on condition of anonymity because they were not authorized to speak publicly.

Meanwhile, the U.N. Security Council has a long-scheduled meeting Wednesday morning to discuss Libya and diplomats said the United States is seeking a council statement on the attack. U.N. Undersecretary-General Jeffrey Feltman, a former American diplomat and close friend of Stevens', is scheduled to brief the council on Libya.

Stevens was a career diplomat who spoke Arabic and French and had already served two tours in Libya, including running the office in Benghazi during the revolt against Libyan leader Moammar Gadhafi. He was confirmed as ambassador to Libya by the Senate earlier this year.

His State Department biography, posted on the website of the U.S. Embassy to Libya, says he "considers himself fortunate to participate in this incredible period of change and hope for Libya."

Clinton said Stevens had a "passion for service, for diplomacy and for the Libyan people."

"This assignment was only the latest in his more than two decades of dedication to advancing closer ties with the people of the Middle East and North Africa which began as a Peace Corps Volunteer in Morocco," Clinton said.

He "risked his own life to lend the Libyan people a helping hand to build the foundation for a new, free nation. He spent every day since helping to finish the work that he started," she said.

Stevens joined the Foreign Service in 1991 and spent his early State Department career at posts in Saudi Arabia, Egypt, Syria and Israel. After working for the Senate Foreign Relations Committee staff for Sen. Richard Lugar, R-Ind., Stevens was posted to Libya as deputy chief of mission.

In that post, Stevens wrote several confidential cables back to Washington, describing Gadhafi's bizarre behavior. During the 2011 revolt against Gadhafi, he was one of the last American diplomats to stay in Tripoli and after the embassy was closed, he was appointed to head the U.S. liaison office to the Transitional National Council. --- Associated Press writer Edith M. Grandfather struck by lightning killed, 9 injured

Matt Kozar, Eyewitness NewsDEMAREST (WABC) -- A 71-year-old man was struck by lightning at Northern Valley Regional High School on Friday afternoon, according to Demarest Fire Department.

It was supposed to an enjoyable Friday afternoon for a grandfather who'd come to watch his granddaughter play soccer.

Instead, around 4:15 p.m. he was struck by lightning and he died at Hackensack Medical Center.

It came out of the sky, through the clouds with a vengeance, stripping the bark off a tree and impaling debris into the neatly trimmed playing fields at Demarest High School.

It was a deadly bolt of lightning that killed a 71-year-old man from Haworth who'd come to watch his granddaughter, a freshman, play soccer.

He was airlifted to Hackensack Medical Center after getting struck, but police tell Eyewitness News the helicopter had to land several miles away because it wasn't safe on school grounds.

"There were a hundred plus students who were evacuated into the south gym for safety purposes," said Chief James Powderly, Demarest Police Department.

"We did see the lightning. We saw it come down from the sky. It was a huge bolt. It was all over the place. So it not only had gotten here, but there was also lightning on the football field. That's why we ran upstairs because we didn't want to be in the line of fire," said Eli Nachmany, a student.

Nine students complained of tingling sensations and first responders rushed them to area hospitals to be evaluated.

This is the third lightning related death this summer.

In July, a 48-year-old woman was killed at a beach in Monmouth County when a line of fast moving storms blew through the area.

In August, a 41-year-old died after getting struck by lightning while fishing with his son in Long Branch.

Back at Demarest High School, the first week back from summer recess has been marked by death and tragedy, particularly for those students who watched it unfold.

"We made sure that our crisis team is here to assess the situation," said Christopher Nagy, Superintendent.

Investigators have not yet released the name of the man who died.

The police chief told Eyewitness News he was on the grounds when this storm was overhead.

He says it was so loud he thought something exploded.

Gas station worker killed during attempted robbery

Web produced by Bill King, Eyewitness NewsNEW YORK (WABC) -- A gas station employee was fatally shot during an apparent attempted robbery while working in the Bronx late Tuesday.

Police say the 28-year-old man, identified as Lamin Sillah, was in the office when two suspects rode up on bicycles to RC Petrolioum on East 182nd Street and Southern Boulevard in the East Tremont section around 9:40 p.m.

Co-worker Jason Mwewa said the gas station was packed at the time, but that didn't stop the suspects. Mwewa had just arrived to relieve Sillah, who was finishing up before he went home.

"The guy pulled out the gun and he put it behind my back," Mwewa said. "I just put my hands up, and he searched my pocket. And as soon as he was done, I walked away. But my co-worker, he was doing paperwork. He didn't see what was happening. And that's when the guy pointed a gun at him. And he just yelled something, like he was surprised, like 'Yo!' and that's when I heard three shots rang out."

Police say the suspect, covering his faces with a hoodie, shot Sillah several times before fleeing on the bicycle. Mwewa said he gave chase, but was unable to catch anyone or see any faces because of the hoodies.

Sillah was pronounced dead at St. Barnabas Hospital.

""I just want justice for this guy," Mwewa said. "I hope they find the person who did it...This guy, he's the most honest person I've ever come across. That's why whoever did this, you gotta try to find the guy. This guy worked so hard. He probably has a family that's depending on him. So this guy is a really, really good guy."

Police are looking at surveillance video they recovered from the scene.

Sillah's family said he only started working at the gas station 10 days ago, and that the came to U.S. with a student Visa from Gambia just 10 months ago to get more education. Roommate and cousin Mohommad Kijera was devastated.

"We sleep together, you know, we eat together, anything, we do it together," he said. "In that sense, he wasn't lonley. But now I'm lonely."

No arrests were immediately made.

Parents of Girl Killed by Loughner Pray for Giffords

John and Roxanna Green's nine-year-old daughter, Christina-Taylor, was the youngest victim of last year's shooting in Tucson, the same spree that seriously injured Arizona Congresswoman Gabrielle Giffords.

Twenty-three-year-old Jared Loughner, the accused killer, has been declared incompetent to stand trial, and sits in prison.

"I don't think about him," Roxanna Green told "Nightline" anchor Cynthia McFadden. "I think of, that she was, like, in a car accident."

The Greens said they had not attended any of the court proceedings and had no plans to, unless their participation were needed to serve justice.

"A waste of our energy," John Green said.

Asked what their reaction would be if the incompetent-to-stand-trial ruling stood and Loughner simply remained incarcerated, the Greens said they could accept it.

"As long as he never hurts anyone ever again, and is never able to get out ... I would be O.K. with that," said Roxanna Green.

If Loughner did end up convicted of murder and executed, would the Greens take some comfort from his death?

"Not really," said John Green, who nonetheless supports the death penalty, according to Roxanna Green's new book. (She does not.) "It's not going to bring my girl back."

Loughner is never mentioned in "As Good As She Imagined," the book Roxanna Green wrote with best-selling author Jerry Jenkins, which came out Jan. 3.

The Greens met with Congresswoman Giffords and her husband, Mark Kelly, over the Thanksgiving holiday, they said. Giffords and Kelly gave the Greens' son, Dallas, a model rocket signed by Kelly, an astronaut.

"We just kind of hugged each other and supported each other and said, you know, we're all in this together," John Green said. "We wanted to make sure they didn't harbor any guilt."

"It was nice to tell her in person that, you know, we love her, we're praying for you, and we hope you get better every day," Roxanna Green said.

On the morning of the shooting, Roxanna Green said, she made sure Christina-Taylor fastened her seatbelt, then went back into the house to get a hoodie for her to wear to keep out the winter-morning chill. The hoodie was tie-dyed and had a peace sign on the back, she said.

Christina-Taylor was driven to the Giffords event -- she had an interest in politics and had volunteered for Giffords' campaign -- by a neighbor.

Roxanna Green said the neighbor's husband called her, saying he'd just gotten a call and that Roxanna needed to go to University Medical Center.

"I asked him, Did they get in a car accident? What had happened?" Roxanna Green said.

When Roxanna Green got to the hospital, the doctor told her "they tried their very best to save her but they just couldn't," she recalled, adding the doctor and the intensive-care nurses were in tears.

John Green arrived soon after, and the news left him "totally numb," he said.

President Obama met with the Greens in Tucson before the memorial service for the victims and survivors of the shooting.

"He said, 'There aren't any words, I'm so sorry,' and he gave us both a huge hug, and so did Mrs. Obama, and it just felt genuine and special," recalled Roxanna Green. "They just know, because they're parents, and they have the two lovely daughters. And it was just very comforting."

The title of Roxanna Green's book comes from a line in the speech President Obama gave in Tucson: "I want America to be as good as she imagined it."

Four people survived the accident, though a mother and daughter remain in critical condition. Sadly, police say the three young men who died could've been saved if they had been wearing their seat belts.

Authorities say 18-year-old /*Hlias Iliopoulos*/, his 13-year-old brother /*Chrystoph Iliopoulos*/ and their 15-year-old friend /*Eric Colligan*/ were pronounced dead at the scene. Iliopoulous' 20-year-old sister Fontiny, her 25-year-old fiance /*Vincent Whiteaker*/ and her parents, 51-year-old /*Stavroula Iliopoulos*/ and 54-year-old /*Dimitrios Iliopoulos*/, were rushed to the hospital.

"It's hard to see on your block, with your neighbors," Danielle Callan said. "It's very upsetting."

State Police Capt. Frank Davis says a car passing at a high speed may have scared the driver and caused him to lose control and slam into the guardrail. The speeding car may have been black or dark-colored BMW or Mercedes-Benz.

Young mother shot and killed in the Bronx

Web produced by Bob Monek, Eyewitness NewsTREMONT (WABC) -- Police in the Bronx are searching for the gunman who shot and killed a young mother with her child at her side.

"I don't know anybody in the world that would want to hurt this girl," her husband, Juba Lassiter, said.

Claudia Millan , 29, was walking with her 2-year-old son, Jamir, on Park Avenue Sunday night.

Around 9:30, she stopped to talk to her neighbor, Michael. A half-hour later, he heard a gunshot and ran outside to see what happened.

He said she was on the ground, shot in the face.

"After I heard the shot, I cam over here and I seen the little kid bleeding over his mother," Michael Escobar said. "He was down on his knees with her, trying to hold her."

The father of two of their young children said he is physically ill over what happened.

Lassiter said he and Claudia were married seven years. He was visiting Pennsylvania with his sister when the shooting happened.

"He loves his mom. They all love their mom. Before anything comes their mom. Now, what am I supposed to tell them?" he said.

"Jamir does reenact what happened. He does put something to his face exactly where his mother's wounds was, because I did go to the morgue to see her. He keeps asking for her. He is really devastated right now," Clarissa Lawson, the victim's sister-in-law, said.

Lighting candles and filled with grief, family members and friends are trying to comprehend that she is gone and that someone would do this.

"That's how they live life. By doing wrong and by hurting people and by taking people away from their family because they have nothing to live for," Lassiter said.

See it on TV? Check here. Web produced by Bill King, Eyewitness NewsNEW YORK (WABC) -- Fleet Week took a tragic turn early Thursday, as a Marine was struck by a car and killed while trying to cross a street on the West Side.

The 22-year-old Marine had just come into town on one of the boats arriving for the festivities Wednesday.

He was crossing 12th Avenue at 49th Street around 1 a.m. when he was hit. He was one of several people who had just gotten out of a cab and were attempting to cross the Westside Highway from the center median. He was pronounced dead at the scene.

Police are looking into whether the driver of the silver Acura that hit him fled the scene or was just turning around to come back, because the driver did return shortly after the incident. It is believed that driver is the one who called 911.

The driver is in custody, but at this point does not face any charges.
