Elderly pedestrian killed when car jumps curb

NEW YORK (WABC) -- 62-year-old Denise Baum is covered from head-to-toe in bruises, but it is her shattered heart which stings the most.

She and her husband were trying to hail a cab Saturday night on Park Ave and 59th Street when a two-car collision at that same intersection and at that same moment, sent one of the vehicles flying in their direction.

By the time the Mazda stopped, 80-year-old Rubin Baum was under the car and no longer breathing.

"He was pinned under the car, he was pinned - I couldn't pick up the car," Denise said.

"I heard the crash - it hit the man and woman on the corner waiting for a cab," said eyewitness Terry Hill.

Rubin Baum received two Purple Hearts for his valor and heroism during the Korean War.

Denise believes her husband's last act alive was to push her out of the way, which is why she survived, and he didn't.

"I believe he shoved me, I remember going in the air," Denise said.

Rubin Baum was debonair and dashing, and wore his decades well.

He taught his children to be kind to strangers and to root for the Giants.

He danced through his life with his wife. Tonight, all she is asking for is answers.

The minivan has diplomatic plates. Police tell Eyewitness News that the Pakistani official was not in the car during the accident, and police do not believe either driver will be charged. They are calling this a tragic accident.
