Woman alleges long affair with Herman Cain

AP  Eyewitness NewsATLANTA -- Republican candidate Herman Cain declared "Here we go again" as he faced the latest crisis in his presidential campaign: an accusation of a 13-year extramarital affair with an Atlanta businesswoman.

On Monday, Ginger White said in an interview with Fox 5 Atlanta that her affair with Cain ended not long before the former businessman from Georgia announced his candidacy for the White House.

"It was fun," said White, 46, as she described how Cain had bought her plane tickets for a rendezvous in Palm Springs, Calif.

"It was something that took me away from my sort of humdrum life at the time. And it was exciting."

Cain went on television to deny White's claims even before the report aired. It was a faster and more deliberate response than he had managed when it was reported that three women alleged he had sexually harassed or groped them when he was the president of the National Restaurant Association in the mid- to late 1990s. The trade group paid settlements to two women who had worked there.

"Here we go again," Cain told CNN as he denied White's accusation. "I didn't do anything wrong."

Cain avoided reporters and their questions when he attended a fundraising event Monday night in the Virginia suburbs of Washington. That may be more difficult Tuesday, when he is scheduled to speak to students at Hillsdale College in Michigan, or Wednesday, when he is scheduled to begin a bus tour through Ohio.

As some conservative Republicans sought an alternative to Mitt Romney, Cain surged in the polls while pushing his 9-9-9 tax plan and providing tough criticism of President Barack Obama during televised debates.

But as the harassment stories surfaced, Cain stumbled in explaining his views about U.S. policy toward Libya and other foreign policy issues, creating an opening for rival Newt Gingrich to assert himself as a more reliable, seasoned politician to challenge Romney and even Obama. Cain fell in the polls and Gingrich began to rise.

Although Cain said Monday there had been no affair with White, his lawyer issued a public statement that included no such denial and suggested that the media - and the public - had no business snooping into the details of consensual conduct between adults.

After the initial report and Cain's denial, White told The Associated Press that Cain was not being truthful when he said there had been no affair.

"That would be false," White said. "What I said in the interview was true."

At her apartment in Dunwoody, Ga., White declined to elaborate on her statements during a brief interview with the AP. "I can't make any comment on this," she said. "We're trying to be slightly sensitive."

In its report, Fox 5 Atlanta said White had Cain's name in her cell phone contacts, and when its reporter sent a text message to the number, Cain called right back.

"He told us he knew 'Ginger White' but said these are more false allegations," the station reported. Cain said White had his number because he was trying to help her financially.

In a written statement released immediately after the story aired, Cain's campaign said detractors were trying to "derail the Cain Train with more accusations of past events that never happened."

In his initial denial, Cain vowed to remain in the presidential race as long as he has the support of his wife, with whom he said he had discussed the most recent allegation.

In her interview, White said she decided to come forward after seeing Cain attack his other accusers in an appearance on television.

"It bothered me that they were being demonized, sort of, and being treated as if they were automatically lying, and the burden of proof was on them," she said. "I felt bad for them."

White told the Atlanta TV station she expects to be scrutinized by Cain and the media.

Georgia court records show a series of judgments against White for not paying rent in Atlanta-area apartments, including one filed about two weeks ago.

In the interview, she said she first met Cain in the late 1990s in Louisville, Ky., when he was president of the National Restaurant Association. They had drinks and he invited her to his hotel room, she recalled.

She quoted Cain as telling her, "You're beautiful to me and I would love for us to continue this friendship," then produced his personal calendar and invited her to meet him in Palm Springs.

White has been accused of lying before. A former business partner, Kimberly Vay, filed a libel suit as part of a larger business dispute with White. Vay's attorney, Kurt Martin, said a judge sided with Vay after White failed to respond to the suit.

Martin said a jury must still decide whether to award damages.

White's attorney, Edward Buckley, acknowledged the libel suit.

He said White thought the libel claim had been settled as part of a larger settlement.

'Frosty the Snowman' arrested at Maryland parade

AP  CHESTERTOWN, Md. -- Who says "Frosty the Snowman" has to be jolly?

A man in a "Frosty the Snowman" costume was arrested Saturday during the annual Christmas parade in Chestertown, on Maryland's Eastern Shore. He's accused of scuffling with police and kicking at a police dog.

Sgt. John A. Dolgos tells The Star Democrat of Easton that 52-year-old Kevin Michael Walsh became agitated when a dog-handling officer tried to escort him away from the crowd.

Walsh told The Associated Press that he has dressed as Frosty in the parade for at least 10 years. He says he was wrongfully arrested. He says an officer hassled him after he remarked about the police dog's presence. He says he became agitated only after getting arrested.

Walsh was released on his own recognizance.

Activists: Stop black bear hunt before it starts

AP  By ANGELA DELLI SANTITRENTON -- Animal protection groups are heading to court Tuesday to try to convince a New Jersey appeals panel to halt this year's black bear hunt in its tracks.

The case is expected to be decided by Dec. 5, the scheduled start of a six-day hunt in the northwest part of the state.

The Animal Protection League of New Jersey and The Bear Education and Resource Group will try to convince the judges that the state's Comprehensive Bear Management Policy is flawed. The policy includes an annual hunt.

The state maintains a hunt is necessary to keep the black bear population in check.

The Department of Environmental Protection recorded 2,667 reports of bear activity this year through October. That number includes bear sightings, attacks on livestock, 46 home entries and 516 reports of bears picking through garbage.

Bear activity has been reported in 19 of the state's 21 counties this year.

Hunters killed 592 black bears last year. It was the first hunt in five years.

The animal activist groups failed to get last year's hunt stopped, but their court case was allowed to continue.

"The black bear policy is full of scientific flaws, self-contradictions and outright fabrications," said Doris Lin, director of legal services for the BEAR Group. "The lawsuit is not about philosophical objections to hunting; it's about integrity and science, both of which are missing from the policy."

For example, she says the number of bear complaints is actually decreasing, and that the state's claims are based on more police departments being included in the reporting data.

A judge acting on a petition to the state Supreme Court refused to grant an emergency stay last year, after an appeals panel declined to call off the hunt.

A similar challenge succeeded in 2007 and no hunt was held. An appeals panel found flaws with the management policy and ruled that the 2005 hunt should not have taken place.

Some 6,680 bear hunting permits were issued for last year's hunt, with each hunter entitled to one bear regardless of age or gender. The DEP maintains the right to halt the hunt early based on the number of bears killed.

The hunt is held concurrently with the firearm deer season. Bear hunting is allowed in the area north of Interstate 78 and west of Interstate 287.

Besides a hunt, the Comprehensive Black Bear Management Policy developed by the Division of Fish and Wildlife includes education, a bear feeding ban and aversive conditioning.

Memorial grows for slain Bronx teen

Web produced by Jennifer Matarese, Eyewitness NewsNEW YORK (WABC) -- There were a lot of tears and emotions at a growing memorial Monday night for a teenager gunned down in the streets of New York.

It began as a night of fun with friends, but it turned deadly in an instant, and seemingly for no reason at all.

There is still no arrest in this senseless killing.

While police search for the gunman, the memorial outside the victim's apartment is growing.

The candles at the memorial spell his name, Kurt.

The 17-year-old high school senior, Kurt Lawrence, was fatally shot early Saturday morning.

He was an honor roll student who poured all his passion into football.

Kurt was hoping for a college scholarship to pull him out of the South Bronx and into the pros except a bullet to the chest put an end to all that.

For the Lawrence family, the tragedy rips open painful wounds.

Seven years ago, Kurt's older brother J.J. was gunned down a block from the house.

His father passed from an illness two years ago.

And now Kurt leaves behind a grieving single mother and three sisters.

The victim was at a party this weekend.

At around 2 in the morning, Kurt and his friends stepped outside for a moment.

Police say that's when another group of men approached.

Eyewitness News is told that no words were ever exchanged, just the sound of gunfire.

Caught on tape: Aging football players get in fight

The Canadian Football League was honoring former stars Joe Kapp and Angelo Mosca.

The men, both 73 years old, appeared to tease each other when they first saw each other, but then one man started swinging his cane.

That's when punches were thrown and chaos ensued.

The grudge was over a hard hit during a game 48 years ago.

Syracuse's Boeheim could speak on scandal Tuesday

AP  By JOHN KEKISSYRACUSE, N.Y. -- Syracuse men's basketball coach Jim Boeheim could speak out about the sex abuse allegations surrounding his former assistant coach after a home game scheduled for Tuesday night.

Boeheim ran a closed practice Monday as sex abuse victims' advocates questioned whether he should still coach following the firing of Bernie Fine, who has been accused of molestation by three men.

As criticism swirled about Boeheim's initial support of Fine and his verbal attacks on the accusers, the coach kept a low profile, seeking refuge in his office on the second floor of the Carmelo K. Anthony Basketball Center.

Boeheim, who had been sharply critical of the accusers, has softened his stance 10 days after an impassioned defense of Fine, who spent 35 seasons on the bench next to Boeheim and was fired Sunday.

The Rev. Robert Hoatson, president of Road to Recovery, a group that supports victims of sexual abuse, said the dismissal of Bernie Fine was appropriate but didn't go far enough.

"I think Jim Boeheim should be fired or resign as well," Hoatson said Monday. "These boys were members of the basketball program. Jim Boeheim's responsibility is to oversee that program, and the children were not safe on his watch."

Two former Syracuse ball boys were the first to accuse Fine, who has called the allegations "patently false." And a third man came forward last week, accusing Fine of molesting him nine years ago.

Bobby Davis, now 39, told ESPN that Fine molested him beginning in 1984 and that the sexual contact continued until he was around 27. A ball boy for six years, Davis told ESPN that the abuse occurred at Fine's home, at Syracuse basketball facilities and on team road trips, including the 1987 Final Four. His stepbrother, Mike Lang, 45, who also was a ball boy, told ESPN that Fine began molesting him while he was in fifth or sixth grade.

Zach Tomaselli, 23, of Lewiston, Maine, said Sunday he told police that Fine molested him in 2002 in a Pittsburgh hotel room.

Tomaselli, who faces sexual assault charges in Maine involving a 14-year-old boy, said Fine touched him "multiple" times in that one incident. During a telephone interview with The Associated Press, he said he signed an affidavit accusing Fine following a meeting with Syracuse police last week in Albany.

As supporters of victims of sex abuse called for Boeheim to be fired, university trustees were largely silent.

"I don't have anything to say about this," said trustee H. Douglas Barclay, who earned his law degree from Syracuse in 1961 and was a New York state senator for 20 years.

Reached in Naples, Fla., trustee Marvin Lender, class of 1963, referred all calls to Chancellor Nancy Cantor.

"It's a policy, and I want to adhere to it," he said.

The allegations against Fine surfaced a week after Penn State school trustees fired Joe Paterno in the aftermath of child sex abuse charges against former defensive coordinator Jerry Sandusky, who is accused in a grand jury indictment of sexually abusing eight boys over a 15-year period.

Amid that child sex-abuse scandal, Penn State's trustees ousted Paterno and university President Graham Spanier. The trustees said Spanier and Paterno, who is not the target of any criminal investigation, failed to act after a graduate assistant claimed he saw Sandusky sexually abusing a young boy in a campus shower in 2002. And two school administrators were charged with not properly alerting authorities to suspected abuse and with perjury. They maintain their innocence.

When the allegations against Fine first became public Nov. 17, Boeheim adamantly defended his longtime assistant and attacked the accusers, saying he suspected they were trying get money.

"It is a bunch of a thousand lies that he has told," Boeheim told ESPN, referring to Bobby Davis. "You don't think it is a little funny that his cousin (relative) is coming forward?"

Those comments prompted a swift backlash from victims' advocates, who were outraged by Boeheim's attitude.

Ten days later, his stance had changed considerably.

In a statement released Sunday night after Fine's firing, Boeheim expressed regret for his initial statements that might have been "insensitive to victims of abuse."

"What is most important is that this matter be fully investigated and that anyone with information be supported to come forward so that the truth can be found," Boeheim said in a statement released by the school. "I deeply regret any statements I made that might have inhibited that from occurring or been insensitive to victims of abuse."

That apology did not appease all his critics.

Richard Tollner, a member of the New York Coalition to Protect Children, said even if the investigation finds Boeheim didn't know anything before, during or after any abuses occurred, he should at least offer to quit. Tollner and other victims' advocates have been sharply critical of comments Boeheim made when the scandal broke in which he said the accusers were lying to get money.

"We think he should offer his resignation to the Syracuse University Board and the let the board decide with a vote of confidence whether he should continue on or not," said Tollner.

"Mr. Boeheim has a responsibility," Tollner said. "He's a leader. Kids follow what Jim Boeheim says these days. In that light, he should have been more responsible in his remarks."

New York state Assemblywoman Margaret Markey, a Queens Democrat who has passed legislation increasing the age from 23 to 28 to bring a claim of sexual abuse, said if an investigation shows Boeheim was aware of the allegations against Fine and did nothing, he should be removed.

"But if he wasn't aware of it, and there was no way of him knowing about it, that's a different set of circumstances," Markey said.

On Sunday, ESPN also played an audiotape, obtained and recorded by Davis, of an October 2002 telephone conversation between him and Fine's wife, Laurie.

Davis told ESPN he made the recording, which also has been given to Syracuse police, without her knowledge because he knew he needed proof for the police to believe his accusations. ESPN said it hired a voice recognition expert to verify the voice on the tape and the network said it was determined to be that of Laurie Fine.

During the call to the woman, Davis repeatedly asks her what she knew about the alleged molestation.

"Do you think I'm the only one that he's ever done that to?" Davis asked.

"No ... I think there might have been others but it was geared to ... there was something about you," the woman on the tape said.

On the tape, she also says she knew "everything that went on."

"Bernie has issues, maybe that he's not aware of, but he has issues. ... And you trusted somebody you shouldn't have trusted ...

" Federal authorities investigating Fine are not hampered by a statute of limitations should they turn up evidence Fine molested Tomaselli in Pittsburgh.

Under federal law passed in 2002, prosecutions for the sexual or physical abuse or kidnapping of a child under 18 can continue until the victim turned 25. Subsequent amendments changed that to the life of the child or 10 years after the offense, whichever is longer.

On Sunday, Tomaselli's father said he was lying.

In a phone interview with the AP, Fred Tomaselli said: "I'm 100 percent sure that Bernie Fine was never in contact with Zach. He never went to Pittsburgh to a game, never been to that arena."

Zach Tomaselli's friend, Rose Ryan of Lewiston, Maine, defended him Monday against his father's claim that he made up the story about being molested by Fine.

"He's not lying," said Ryan, who said Tomaselli provided detailed descriptions to police of the Pittsburgh hotel and of the interior of Fine's home.

Ryan, who's 31, said Tomaselli worked as a camp counselor and a baseball umpire but is currently unemployed and having difficulty finding work because of sex charges pending against him in Maine.

Tomaselli was arrested in April on 11 warrants charging gross sexual assault, tampering with a victim, two counts of unlawful sexual contact, five counts of visual sexual aggression against a child and unlawful sexual touching and unlawful sexual contact, Lewiston police said. They did not say what led to the charges. He has pleaded not guilty.

John Duncan, executive assistant U.S. attorney in Syracuse, said a search warrant was executed Friday by the U.S. Secret Service at Fine's residence. He declined to say Monday what was sought or found, saying it remains under seal. "His home was searched," he said.

U.S. Secret Service agent Tim Kirk in Syracuse declined to comment and referred questions to Duncan.

Lee Kindlon, a criminal defense attorney who practices in state and federal courts in upstate New York, said while the statute of limitations won't bar federal prosecutors at this point, they have other issues including the credibility of the accuser and lack of physical proof.

"But these allegations are serious and I think the feds are doing the right thing and looking for proof to back up the accusations," he said.

Also Monday, the Syracuse Police Department said it will provide details of its investigation to the Onondaga County District Attorney's Office on Tuesday, heading off a court appearance that was scheduled for Tuesday morning. DA William Fitzpatrick had complained that the police were not sharing details and accused the police chief and others of leaking information to the media, a claim the police denied.

A two-paragraph statement from the city police noted that the case had entered a "new phase" with the U.S. Attorney and Secret Service taking the lead.

NYC shooting suspect caught on camera

  Eyewitness NewsNEW YORK (WABC) -- The NYPD is looking for a shooting suspect who was caught on camera in Brooklyn.

Surveillance video shows a man quickly pulling out a gun and shooting another man in the leg.

The incident happened on New Lotts Avenue in Brownsville last Wednesday afternoon.

The victim was wounded, but the injury was not life threatening.

Police say the suspect is about 5-foot-8 and weighs 200 pounds.

Winter's Eve tree lit up at Lincoln Square

See it on TV? Check here.NEW YORK -- The holiday season is in the air. Can you feel it?

It was certainly on display on the Upper West Side on Monday during the Twelfth Annual Winter's Eve at Lincoln Square. New York City's largest holiday festival will kicked off with a neighborhood tree lighting ceremony at Dante Park -- but that's just part of the fun.

After the lights went up with famed folk artist Arlo Guthrie and ABC7's own Sade Baderinwa on hand, the sidewalks along Broadway from Columbus Circle to 68th Street was buzzing with performers, street musicians, jugglers, stilt-walkers and other entertainers. The event featured more than 20 live musical acts highlighted by an appearance by Guthrie, as well as the Newark Boys Chorus and the Grammy-winning klezmer band, The Klezmatics; and a show by renowned jazz bassist Christian McBride and his quartet at the Apple Store on 67th Street.

Food enthusiasts indulged in tastings for $1-$5 a taste from more than 30 local eateries stationed under canopies at Columbus Circle. In addition, there was a variety of free activities for the kids, including a performace by Joanie Leeds & the Nightlights at Kids' Central at the American Bible Society, a book reading and signing of "Eddie Shapes Up" with former NYC Mayor Ed Koch, giant puppets from Arm-of-the-Sea Theater and two shows of the Big Apple Circus' "Boughs and Holly: Entertainers Extraordinaire" at Time Warner Center.

Admission to Winter's Eve was free, but people brought their gently used coats or a new coat of any size to help keep local children and families warm this winter and support the New York Cares Coat Drive. New York Cares especially needs children's coats and large men's coats this season to help those in need citywide.
