Questions surround deadly Queens police shooting

Web produced by Bill King, Eyewitness NewsQUEENS (WABC) -- There are more questions than answers after a deadly police shooting in Queens early Thursday left an unarmed National Guardsman dead.

Noel Polanco, 22, was shot and killed by an officer on the Grand Central Parkway, near LaGuardia Airport, during a traffic stop around 5 a.m.

Now, his mother is speaking out, asking why her son had to die.

"I'm going to continue to make sure that his name does not get taken down by mud," Cecilia Reyes said. "They took him from me, and this is not going to stay like this. They're not going to make my son out to be the bad guy, because he's not."

NYPD Commissioner Ray Kelly has not yet spoken about the case, which appears to be very complicated for everyone involved.

Minutes before the shooting, surveillance video recorded Polanco and friends leaving the Ice Bar in Astoria. Investigators say Polanco got onto the parkway and began weaving in and out of lanes.

Dianne DiFerrari was in the passenger seat when she says Polanco cut off two unmarked police cars. She says one of them pulled up next to their Honda, and one man began screaming obscenities through her open window.

When they pulled over, she she says heavily armed men surrounded them. She says she had no idea they were officers until she heard the pop of the shot that killed her friend.

"He was shot intentionally, no doubt in my mind," she said. "Because there was no reason to even have your guns drawn the way they did. All you had to do was pull him over, ask him for his freaking license and registration and take him to jail. There was no reason for this innocent kid to be killed."

The officer who was involved in the shooting has been identified as 39-year-old Hassam Handy, who has been on the force for quite some time.

New details emerge in Pathmark shooting

AP  BRUCE SHIPKOWSKITRENTON -- A New Jersey supermarket employee who gunned down two co-workers and then killed himself there last month did not argue with or speak to any colleagues before he initially left the store, according to new information disclosed Saturday afternoon.

Terence Tyler, a 23-year-old former Marine who had worked at the store as an overnight clerk for less than two weeks, was armed with an assault-style rifle and two other weapons when he returned to the Old Bridge Pathmark on Aug. 31. Middlesex County Prosecutor Bruce Kaplan said Tyler legally obtained the weapons while in California, but the rifle - a WASR-10 Romanian, similar to an AK-47 assault weapon - was illegally modified.

Kaplan also said Tyler misrepresented certain details in applications to purchase the weapons, which he brought with him when he moved to New Jersey in June. Kaplan said the rifle Tyler had is illegal in New Jersey.

Specific details on the weapons were among several new pieces of information Kaplan made public. He said the decision to release additional details of the shooting came after authorities weighed the legitimate public interest against the privacy rights of the families of the two slain employees, 18-year-old Cristina LoBrutto and 24-year-old Bryan Breen, who both lived in Old Bridge.

Kaplan said Tyler left the store at 3:30 a.m. without talking to any of the 12 other employees in the store that night. He drove to his home in Old Bridge, changed into military-issue desert camouflage clothes and returned to the store about 30 minutes later.

Moments after arriving, Tyler left his vehicle and started firing the assault rifle as he headed toward the supermarket. He aimed at an employee who was standing outside the store but missed, and the employee ran inside to warn co-workers.

Tyler then entered the store and continued firing at employees, Kaplan said, but had no intended target and was firing randomly. He shot out the front of the store, shattering windows, and then fired at five co-workers. Tyler eventually killed himself, firing a single shot to his head with the .45-caliber handgun.

The Middlesex County Medical Examiner's Office determined that Breen died instantly, and LoBrutto died moments after being shot. Each died from a single gunshot wound.

Tyler was not wearing a bullet-proof vest when he opened fire, Kaplan said. The gunman fired 19 shots from the rifle, and police recovered 281 rounds of ammunition for the weapon.

911 calls released from Pathmark shooting

AP  Eyewitness NewsOLD BRIDGE -- Employees at a New Jersey supermarket can be heard on 911 calls begging for police to send help as a gunman goes on a rampage.

The calls from the Aug. 31 shooting at the Pathmark in Old Bridge were released Thursday.

LINK: LISTEN TO 911 CALLS Several of the calls are from terrified employees trapped inside the store during the shooting. One female employee can be heard breathing heavily as she begs a police dispatcher to send help.

Other employees give the dispatcher eyewitness accounts of a fellow employee entering with a shotgun and firing. Authorities determined the gun to be an assault rifle.

Authorities say 23-year-old employee Terence Tyler shot two co-workers and then killed himself. Eighteen-year-old Cristina LoBrutto and 24-year-old Bryan Breen each died of a single gunshot.

George Zimmerman reenacts shooting

"He took my head and slammed it against the concrete several times, and each time I thought my head was going to explode and I thought I was going to lose consciousness," George Zimmerman told police the day after he shot and killed Trayvon Martin.

"I started screaming for help," but Martin pressed his hands over Zimmerman's mouth and nose, he said. "He told me to shut the f&#k up, and I was suffocating."

Zimmerman told police he was lying on the ground, but his head was on the concrete.

"I didn't want him to keep slamming my head on the concrete so I kind of shifted. But when I shifted my jacket came up…and it exposed my firearm. That's when he said you are going to die tonight. He took one hand off my mouth, and slid it down my chest. I took my gun aimed it at him and fired."

The latest and most detailed account yet of what happened in Sanford, Fla., on Feb. 26 comes from a voice stress test that Zimmerman passed, along with a video re-enactment, a handwritten statement and audio interviews conducted in the days after the shooting by investigators.

The material was released by Zimmerman's attorney today on the website gzlegalcase.com, a website managed by the Zimmerman defense team.

The relatively consistent statements portray a man trying to convince investigators that he was in a life and death struggle that left him with little choice but to kill the unarmed teenager.

The documents also show that in the days following the shooting, the lead investigator was not accepting Zimmerman's version of events and recommended that charges be filed against Zimmerman.

"I shot him, and I didn't think I hit him because he sat up and said, 'Oh you got me. You got me, you got it,'" said Zimmerman during a nearly 20-minute re-enactment shot by investigators at the scene of the shooting the next day.

In the video Zimmerman, 28, gives a blow by blow description of how the fight began and depicts Martin as the aggressor, a key point as his legal team builds his defense on Florida's controversial "stand your ground" law.

Zimmerman said he was driving to buy groceries when he spotted the unarmed teen walking near a house that he knew Martin did not live in and called police to report a suspicious person.

"I just felt like something was off about him…and there's been a history of break-ins ... so I said you know just better to call. I kept driving and I passed him, and he kept staring at me and staring around," Zimmerman said.

He took investigators to the house where he first spotted the teen and got on the phone with police. At that point he says he lost sight of Martin.

With bandages clearly visible on the back of his head and nose in the video, he took investigators through the neighborhood showing them where he was when the responder told him that he did not have to follow Martin. Zimmerman says by the time of the request he was no longer in his car and wanted to figure out exactly where he was in the subdivision, so that the officer dispatched to the scene could find him.

"I was walking back. I didn't see anything again, came back to my truck and when I got to right about here, he yelled from behind to me."

"He said, 'Yo, you got a problem?' and I turned around and said no I don't have a problem," said Zimmerman.

Suspects sought in robbery, shooting in the Bronx

  Eyewitness NewsBRONX (WABC) -- Police are looking for two dangerous thieves who robbed a man and shot him in the foot in the Bronx.

Police say one suspect approached the victim in the lobby of a restaurant on East 174 Street in the Tremont section on May 12, pointed a gun at him and demanded money.

Investigators say the thief shot the 28-year-old twice in the foot, then ran off with an accomplice.

One suspect is described as a Hispanic man in his 30s, approx. 5'7" tall, dark skin complexion, short black hair cut and was wearing a dark sweatshirt, blue jeans, black and white sneakers.

The second suspect is a 20-30 year old Hispanic man, approx. 5'11, 190 lbs, light complexion and was wearing a dark baseball hat, khaki pants, black sneakers.

Grandmother accused of shooting grandson 8 times

AP  COREY WILLIAMSBLOOMFIELD TOWNSHIP, Mich. -- Jonathan Hoffman frantically told a 911 dispatcher he had been shot in the chest by his grandmother and was going to die, a police detective testified Monday.

By the time officers arrived at the family's upscale condo in a Detroit suburb, at least four more shots from a .40-caliber handgun had been pumped into the 17-year-old high school senior.

A West Bloomfield Township detective told a judge during Monday's arraignment for 74-year-old Sandra Layne that eight entry and exit wounds were found in Hoffman's body after the Friday afternoon shooting.

Layne has been charged with open murder and held without bond. She stood mute in court when the charge was read, and a not guilty plea was entered on her behalf. An open murder charge allows a jury to decide on whether a first- or second-degree charge applies after hearing evidence.

Hoffman had been attending an alternative high school in nearby Farmington and living with his maternal grandparents so he could complete his senior year while his divorced parents settled in Arizona, according to his father, Michael Hoffman of Scottsdale, Ariz.

Layne's attorneys have said there were problems at the condo, and Layne was afraid of her grandson. One of her attorneys, Mitchell Ribitwer, told reporters Monday that drugs and drug paraphernalia apparently belonging to the teen were found at the condo after Hoffman was killed.

Michael Hoffman said that regardless of his son's behavior, the teen was unarmed and didn't deserve to be shot to death.

Detective Brad Boulet testified about Hoffman's 911 call and said when officers arrived at the condo, Layne was inside, behind a screened door.

"She put the gun on the floor after being ordered so by officers," Boulet said. "She exclaimed she had just murdered her grandson."

Wearing an orange jumpsuit in court, Layne smiled and nodded to her husband and other family members.

Ribitwer described her to the judge as a retired teacher who has lived in the West Bloomfield area for 30 years. His requests for a reasonable bond and electronic tether monitor for Layne were denied. A pre-examination conference for Layne was set for Thursday morning.

Prosecutors had no comment after the hearing. Layne's husband and other relatives attended the hearing but also didn't comment.

Police had responded in March to a domestic disturbance at Layne's home.

"I spoke to the officer who responded, and he indicated this young man was totally out of control in the street," defense attorney Ribitwer told reporters Monday. "He was derogatory to his grandmother. He was yelling and shouting and almost got into it with the police."

Jonathan Hoffman's funeral is set for 11 a.m. Tuesday.

Police investigate deadly shooting in Plainfield

  Eyewitness NewsPLAINFIELD (WABC) -- Police are investigating a deadly shooting in New Jersey.

The incident happened at Roosevelt Avenue, near East Front Street, in Plainfield around 5:30 a.m.

Authorities were called to the scene to a report of a person down in the roadway. They initially thought it was a pedestrian who had been struck by a hit-and-run driver. But as they looked closer, they realized it was a gunshot victim.

The person was pronounced dead at the scene.

The investigation is ongoing, and no suspects are in custody.

Court papers: NYPD officer shooting suspect sorry

Web produced by Jennifer Matarese, Eyewitness NewsNEW YORK (WABC) -- The man charged with murder in the shooting death of a police officer during a botched break-in apologized and said he didn't mean to fire the gun, according to court papers released Wednesday.

Lamont Pride, 27, and four others have pleaded not guilty in the death of Officer Peter Figoski, who was shot once in the face Dec. 12 as he tried to enter the basement apartment, the scene of a reported burglary. While Pride was being driven in a police car to central booking, he told police he was sorry, according to the papers.

"I didn't mean for this to happen," he said. "I didn't want to kill a cop. It went wrong and I'm sorry. I can't take it back," he said, according to the papers.

Through the stack of messy, hand-written statements gleaned from investigators, the plot emerges as a badly-conceived attempt to rob a drug dealer. Authorities said Pride and the others hatched the plot the day before to rob the apartment. Michael Velez, 21, stayed in the getaway car as the four others went in to the dingy, barely finished apartment at 25 Pine St. Ariel Tejada, 22, and Nelson Morales, 27, pistol-whipped the tenant and beat him while they ransacked the place, authorities charged.

When the owner upstairs called 911 to report a commotion in the building, Kevin Santos and Pride hid in a boiler room as Tejada and Morales pretended they were concerned neighbors, authorities said.

Figoski and his partner arrived as backup as Santos and Pride tried to flee. During a struggle between the officer's partner and Santos, Figoski came face-to-face with Pride, who police said shot him once in the face with a semiautomatic handgun. Figoski died hours later at a hospital. His partner pursued Pride on foot and captured him several blocks away, police said.

All five have pleaded not guilty on charges of murder, burglary and robbery.

Details of the ill-fated plan vary, depending on which defendant is telling the story. According to the papers, they all agree on a few details: They went to rob the pot dealer who lived in the basement apartment. Some implicate one another in the crime in some way, either by blaming it all on Pride, as Morales did, or by saying they went to the home but did not participate, as Santos did, according to the court papers.

"I told them I didn't want no part of that so we all get out, the driver stays. I walked across the street, walking slow, watching them as I walked off the police arrived," Santos told investigators, according to papers.

Pride, according to the papers, eventually admitted he had the weapon and told officers he got nervous when he saw police, clutched it with both hands and it accidentally went off.

None of the attorneys representing the suspects commented after a brief hearing Wednesday packed with uniformed officers.

Figoski, who was on the force 22 years, was posthumously promoted to detective.

Investigation into deadly LI pharmacy shooting

  Eyewitness NewsSEAFORD, N.Y. (WABC) -- Police went over the entire crime scene at the pharmacy in Seaford and they still aren't sure exactly how or why the ATF agent was shot and killed Saturday afternoon.

A single flag remembering ATF Agent John Capano now stands where he died New Year's Eve trying to stop an armed robber.

Capano and his friend and neighbor Scott Parlatore used to plow their sidewalks after each snow storm.

Parlatore says the entire town is stunned.

"His wife Dory is obviously devastated and the two kids, 18 and 15, they're holding up very strong. I guess they're in shock, but they're amazing," Parlatore said.

Agent John Capano was picking up medicine for his father at Charlie's Family Pharmacy when an armed robber demanded Oxycotin and cash.

Moments later Capano ran outside to stop the robber, two other off-duty officers were outside and somehow, someone shot and killed the robber and Agent Capano.

Congressmen Peter King knew the agent and his family.

"John died the way he lived. He charged right in. He had to do what he had to do, he was fearless," Rep. Peter King said.

ATF, New York City and local police detectives were back collecting more evidence New Year's day, trying to figure out how Agent Capano died.

They're checking if one of the two other off-duty officers may have accidentally shot him.

Police are investigating whose bullet hit Agent Capano and the robber identified as James McGoey, 43, of Hampton Bays.

Meanwhile, fellow ATF agents, friends and family are comforting the Capano family at their Massapequa home where every neighbor says John Capano would help anyone at any time.

"He was always looking out for everybody else. It's a real tragedy," Parlatore said.

There are so many active and retired law enforcement officers living in Seaford, many wonder how this could happen here where there's rarely any violent crime.

Police ID suspect in 2-year-old's shooting

NEWARK (WABC) -- A young child was fatally shot in Newark, and police now say they are looking for 27-year-old Wakir Bryant.

The 2-year-old boy, identified as Mikhy Robinson, was shot in a house on St. James Place at around 10:30 a.m.

Neighbors say whatever was going on inside the home started as early as 4 a.m.

"It sounded like a dispute, and the son was in the wrong place at the wrong time," said Tyree Williams

The shooting police say, happened at about 9:48 this morning. The child's mother, and Wakir Bryant, rushed the toddler to Beth Israel Hospital, where he was pronounced dead a half an hour later.

Friends of the family came to the scene along with relatives of the victim, who would not speak as they were overcome with emotion, as the reality of the loss sank in.

Newark and Essex county investigators are still trying to piece together how this tragedy unfolded. The mother was being questioned, but Bryant who was with her and the child inside at the time of the shooting left the hospital and police are now searching for him.

Bryant is now wanted for aggravated manslaughter and weapons offenses.

Newark Police Director Samuel DeMaio said, "I am saddened by this tragic and senseless loss of life and extend my heartfelt condolences to the family and loved ones of the infant. The investigation into this incident is in the very early stages and police have yet to clarify all of the details surrounding the case at this time. Nevertheless, I am confident that the hard working investigators assigned to the Essex County Homicide Task Force will conduct a thorough investigation in the pursuit of justice and closure for the family."

Police were looking a white four door Pontiac newer than 2000, with a broken rear passenger brake light.

It was the 90th homicide of the year in Newark.

2 dead, 1 injured in deadly shooting in Brentwood

  Eyewitness NewsBRENTWOOD, L.I. (WABC) -- Police on Long Island are investigating a deadly shooting.

Officers responded to reports of shots fired in an intersection in Brentwood at around 2:50 this morning.

Upon arrival police found three people had been shot.

Two of the victims were pronounced dead and the third was taken to a nearby hospital in serious condition.

Police do not know the cause of the shooting at this time and have closed several roads due an ongoing investigation.

The street closures include Lincoln Avenue between White Street and Hewes Street and Stockton Street between Lincoln Avenue and Madison Avenue.

Anyone with information is asked to contact the Long Island police department.

Suspect sought in stray bullet shooting

  Eyewitness NewsNEW YORK (WABC) -- NYPD is trying to identify a person wanted in connection with shooting that wounded a woman in the Bronx.

It happened just after 8:00 last Friday night (Dec. 2) at East 167 and Westchester Avenue.

Two men were fighting at 967 East 167 Street, the incident caught on tape.

At some point, shots were fired and one of the bullets struck a 20-year-old woman walking with her husband.

She was taken to Lincoln Hospital with a bullet wound to the chest. She was listed in stable condition.

Police are looking for an African-American man, 18-24 years old, approximately 6'3", last seen wearing an orange jacket, blue jeans, green hooded sweatshirt and green and orange hat.

Exclusive: bus shooting victim's widow speaks

  Web produced by Dan Hosea, Eyewitness NewsNEW YORK (WABC) -- Marvin Gilkes was riding on the Q111 bus when a stranger shot him in the back.

Gilkes died instantly, the second victim of an alleged madman who police also accused of murdering his girlfriend's teenaged stepson before he opened fire on the crowded bus.

"I was getting ready for work and he grabbed me and he said, I love you, I'm so in love with you," widow Alicia Gilkes said.

They are words Alicia Gilkes replays in her mind.

One of the last conversations she had with her husband Marvin.

"They say the good die young. So my husband, he was a good man," Gilkes said.

They married in Tobago on July 3, 2010.

Alicia and Marvin met when they were just 7.

They were neighbors in Trinidad.

Marvin would later become a detective on his home island, but quit his job and moved to New York to join his one and only love.

On Friday, Marvin decided to go visit his mother before heading to nursing school.

He jumped on the Q111 bus, never knowing he would cross paths with accused gunman Damel Burton.

Alicia spoke with Marvin right before he got on the bus, reminding him it was pizza night.

"He was like, 'But remember I've got school.' And I said, don't worry we'll leave you some. I'll see you when you get home," Gilkes remembered.

Prosecutors say 36-year-old Marvin Gilkes was shot in the back of the head and died at the scene.

A 29-year-old was struck in the face but survived and is in stable condition.

Queens district attorney's office says that before boarding the bus, Burton first shot at an 18-year-old inside a nearby apartment.

The teen jumped out of a rear window but later died from his injuries.

"I haven't eaten one meal. I'm weak, distraught, he was my everything. My soulmate, it's just been really hard. I never thought I'd be going through this after one year of marriage. I thought we would be growing old together. [It's] very hard," Gilkes said.

Marvin's funeral will be held Wednesday. His family will bring his body back to Trinidad for burial.

Damel Burton, 34, has been charged with murder and attempted murder.

NYC shooting suspect caught on camera

  Eyewitness NewsNEW YORK (WABC) -- The NYPD is looking for a shooting suspect who was caught on camera in Brooklyn.

Surveillance video shows a man quickly pulling out a gun and shooting another man in the leg.

The incident happened on New Lotts Avenue in Brownsville last Wednesday afternoon.

The victim was wounded, but the injury was not life threatening.

Police say the suspect is about 5-foot-8 and weighs 200 pounds.

Four killed in Long Island pharmacy shooting

  Eyewitness NewsMEDFORD, New York (WABC) -- Four people have been killed at a pharmacy on Long Island.

The shooting took place at Haven Drugs, a pharmacy on Southaven Avenue in Medford.

Eyewitness News has learned one of the victims is an 18-year-old who worked at the pharmacy.

Man arrested for shooting dogs with paintballs

  Marci Gonzalez, Eyewitness NewsBUSHWICK, Brooklyn (WABC) -- A Brooklyn man was arrested for allegedly shooting his neighbor's two dogs with paintballs because they were barking.

"This is the one that got blasted in the face," said Pete Wojcik, the dogs' owner.

That blast left the dog's eye swollen shut, and green spots just like the one near her eye covered the 3-year-old pit bull-terrier mix Baby's body.

1 ? year old Birdie was also pelted with paint balls.

"I'm super angry with him, super angry," Wojcik said.

Wojcik has been angry since Wednesday when from inside his Bushwick home, he heard his dogs bark for a moment in the backyard, then something he still can't believe.

"I heard, det, det, det, det, det," Wojcik described.

Wojcik said he found his dogs yelping, his porch plastered by paint bullets, and then he looked up.

He saw his neighbor on the roof three houses down.

The neighbor allegedly fired 40 paint balls at the dogs in the yard because they were barking.

"He kept saying that he didn't kill the dogs, so what does it matter," Wojcik said.

The neighbor, Daniel Lacin who lives in a building down the street was arrested and later released.

He gave no explanation to Eyewitness News for the mess and the pain he's accused of causing.

"I'm happy that he's being taught that you can't just do things like that without a consequence," Wojcik said.

Lacin is charged with Overdriving, torturing and injuring animals and failure to provide proper sustenance for animals, reckless endangerment in the 2nd degree, criminal mischief in the 4th degree, criminal possession of weapon in the 4th degree.

Shooting, chase, and a deadly end in Newark

See it on TV? Check here.  Eyewitness NewsNEWARK (WABC) -- A shooting, and then a car chase, and finally a crash into a third vehicle. When it all came to end, an innocent man was dead in Newark.

The crash happened on Sanford Avenue on Saturday morning.

Witnesses say a gun was found at the found at the scene.

The incident allegedly began when shots were fired from one car at another car. A chase ensued that ended in a collision with the third car.

The driver of the third car was pronounced dead at the scene. Three others suffered injuries.

The force with which the cars hit is as evident from their blasted front ends and shattered windshields as it is from a now-battered intersection, with a light pole cut in half, a fire hydrant toppled and part of a brick building in pieces on the ground.

Three people from the first two cars are hospitalized and have been charged with aggravated assault and weapons charges. Their identities and the identity of the victim were not immediately released.

Newark police and the Essex County Prosecutor's Office are investigating.

4 shot, 1 killed in Newark shooting spree

See it on TV? Check here.   Eyewitness NewsNEWARK (WABC) -- Police in Newark are investigating a deadly shooting in the city's south ward.

One person was shot and killed and three people were injured in the shooting near 399 Irving Turner Boulevard.

It happened shortly after 7 p.m.

Two men and a woman were each shot once in the leg.

Another man was shot once in the arm and died at the hospital.

Police are in the early stages of their investigation.

So far police have not identified a motive for the shootings.

Investigators are still searching for the suspect.

Police look for clues in Brooklyn bus shooting

See it on TV? Check here. Web produced by Bill King, Eyewitness NewsBUSHWICK, Brooklyn (WABC) -- Police on Thursday released surveillance video of a shooting on a New York City bus that left a teenager critically wounded.

The shooting happened at Myrtle and Wilson avenues in Bushwick Wednesday.

Police have new clues in the search for a man who gunned down the teen. They say the suspect pressed the stop button on the bus and then shot the victim on his way off. Investigators are hoping surveillance video will lead to an arrest.

The video, from a security camera outside a bodega, was recorded around 4:30 in the afternoon Wednesday. Police say a man in a blue hoodie shot an 18-year-old on a B-60 bus.

The driver pulled over when he heard the gunfire. He found the teenager shot in the stomach. The victim was rushed to Elmhurst Hospital and is expected to survive. His father says he does not know why his son would be a target.

"It's a disgrace," he said. "This is ridiculous. He's on a bus, a New York City bus, and he gets shot? No argument or nothing? Nobody knows nothing? It's ridiculous."

Police have interviewed witnesses and passengers, and they've collected evidence at the scene, including shell casings.

The name of the victim has not been released. This is the first violent crime on a city bus since a driver was fatally stabbed by a passenger in 2008.

Police are asking anyone with information to call CrimeStoppers at 1-800-577-TIPS.
